Who is at fault when a car hits a pedestrian?+
Almost always the driver, under California Vehicle Code §§ 21950 (right-of-way at crosswalks) and 21451 (drivers must yield). Even when a pedestrian was outside a marked crosswalk, drivers have a duty to use reasonable care — Vehicle Code § 21954 prohibits drivers from creating hazards even with pedestrian noncompliance. California's pure comparative negligence rule allows recovery even if the pedestrian was partially at fault.
What if I was hit in a parking lot or driveway?+
Parking lot and private property pedestrian accidents are still covered. Drivers owe pedestrians ordinary care everywhere, regardless of public-vs-private property. The driver's auto liability policy applies. If the property owner created hazardous conditions (poor lighting, no crosswalk markings, no speed bumps in known pedestrian areas), the property owner may also be liable under premises liability.
Can I recover if there was no crosswalk?+
Yes. Pedestrians have right-of-way at unmarked crosswalks (any extension of a sidewalk across a street counts as an unmarked crosswalk under § 275). Mid-block crossings and jaywalking situations are still recoverable under comparative negligence — the driver's failure to keep proper lookout typically dominates fault assessment. What if it was a hit-and-run?+
Your own auto policy's Uninsured Motorist (UM) coverage applies to hit-and-run pedestrian accidents — the unidentified driver counts as 'uninsured' for UM purposes. We file the UM claim with your insurer immediately, document the accident with police and witnesses, and pursue any independent leads (security camera footage, eyewitnesses, partial license plates). UM coverage often pays more than the at-fault driver's minimum policy would have.
